General Terms

  • These terms and conditions govern your use of InfinityX Enterprise services.
  • By engaging our services, you agree to be bound by these terms.
  • We reserve the right to modify these terms with reasonable notice.
  • These terms are governed by South African law and jurisdiction.

Service Agreement

  • All services are provided subject to a signed service agreement or statement of work.
  • Project scope, timelines, and deliverables will be clearly defined in writing.
  • Changes to project scope may result in additional costs and timeline adjustments.
  • Client cooperation and timely provision of required information is essential for project success.

Intellectual Property

  • Custom software and solutions developed for clients remain the client's intellectual property upon full payment.
  • InfinityX Enterprise retains rights to general methodologies, frameworks, and pre-existing tools.
  • Third-party software licenses and components are subject to their respective terms.
  • Clients must not reverse engineer, modify, or redistribute proprietary InfinityX tools without permission.

Confidentiality & Data Protection

  • We maintain strict confidentiality of all client information and data.
  • Data processing complies with South African POPIA (Protection of Personal Information Act).
  • Client data is stored securely and accessed only by authorized personnel.
  • Non-disclosure agreements are available upon request for sensitive projects.

Payment Gateway Terms & Policies

Pricing Structure

  • Fixed-price quotes provided for all projects
  • Hourly rates for ongoing maintenance and support
  • All prices quoted in South African Rand (ZAR)
  • Prices include applicable VAT where required
  • Payment milestone structure for larger projects

Payment Terms

  • Payment required in full before project commencement
  • Accepted payment methods: Bank transfer, card payments
  • Secure payment processing via trusted gateways
  • Payment receipts provided for all transactions
  • Late payment fees may apply for overdue accounts

Refund Policy

  • Refunds considered on a case-by-case basis
  • No refunds after project work has commenced
  • Cancellation within 7 days may qualify for partial refund
  • Refund processing time: 7-14 business days
  • Administrative fees may apply to refund requests

Liability & Warranties

Limitation of Liability

  • • Liability limited to project value or R50,000, whichever is less
  • • No liability for indirect or consequential damages
  • • Force majeure events exempt from liability
  • • Client responsible for data backup and recovery
